The Third and Final BASF and Huntsman Distribution commenced on December 1, 2016.

These payments are not related to the settlement with The Dow Chemical Company, which will be administered in a separate claims process.

On February 26, 2016, Class Plaintiffs and The Dow Chemical Company agreed to settle the claims against Dow for $835 million. If you bought Polyether Polyol Products directly from a Defendant at any time from January 1, 1999 through December 31, 2003 in the United States and its territories, your rights may be affected by the settlement with Dow. This website provides information relating to the litigation and the settlement, including the nature of the claims; the parties; and the settlement approval and claims process. The Settlement Agreement is available in the “Case Documents” section of this Website.

The Fairness Hearing was held on July 27, 2016 and the Court approved the Settlement, the Plan of Allocation, and the request for an award of attorney’s fees, incentive awards, and reimbursement of costs and expenses on July 29, 2016. The Court’s orders and the Plan of Allocation are available in the “Case Documents” section of this Website.

Class Members will be sent a personalized claim form showing the dollar volume of their eligible purchases. Only your purchases between November 24, 2000 and December 31, 2003 will be eligible for recovery from the Dow Settlement. A date for mailing claim forms has not been established. Please check this website in the future for any updates regarding the claims process.
